DMCA Copyright Policy

01Overview
PHOOM respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

03Filing a DMCA Takedown Notice
If you believe that content on PHOOM infringes your copyright, please submit a written notification containing the following information:
- Identification of the copyrighted work: describe the copyrighted work that you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material: provide the URL(s) or other specific location of the material you claim is infringing, with enough detail for us to locate it.
- Your contact information: include your full name, mailing address, telephone number, and email address.
- Good faith statement: a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: your physical or electronic signature.

04Our Response to Valid Notices
Upon receiving a valid DMCA takedown notice, we will:
- Expeditiously remove or disable access to the allegedly infringing content
- Notify the user who posted the content that it has been removed
- Provide the user with information about how to file a counter-notification
05Counter-Notification
If you believe your content was wrongly removed due to a mistake or misidentification, you may submit a counter-notification containing:
- Identification of removed material: identify the material that was removed and its location before removal.
- Consent to jurisdiction: a statement that you consent to the jurisdiction of the Federal District Court for your address (or the Northern District of California if outside the US), and that you will accept service of process from the complainant.
- Good faith statement: a statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your contact information: your full name, address, telephone number, and email.
- Signature: your physical or electronic signature.

06Restoration of Content
Upon receiving a valid counter-notification, we will:
- Forward the counter-notification to the original complainant
- Restore the removed content within 10 to 14 business days, unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity
07Repeat Infringer Policy
PHOOM maintains a policy to terminate, in appropriate circumstances, accounts of users who are repeat infringers. We may terminate an account if:
- The user has received multiple valid DMCA takedown notices
- The user has repeatedly uploaded infringing content after being warned
- We determine, in our sole discretion, that the user is a repeat infringer
08Misrepresentation Warning
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Before filing a notice, please ensure you have a good faith belief that the use is actually infringing.
