Terms of Service

By accessing or using PHOOM ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

PHOOM provides a link-in-bio platform designed for VTubers and content creators. The Service allows users to create profile pages featuring links, model showcases, and social media connections.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One person may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

Usernames

Your username is unique, ties directly to your default page URL (phoom.page/your-name), and represents you on the platform. The following rules apply:

• Usernames are assigned on a first-come, first-served basis among accounts that comply with these Terms.
• You may change your username at most once every three (3) months, and only to a name that is currently available.
• You may not register, hoard, accumulate, or hold usernames with the intent to sell, transfer, rent, trade, or otherwise profit from them. Operating or participating in any marketplace, auction, or brokerage for PHOOM usernames is prohibited.
• You may not register a username primarily to block, impersonate, mislead, or extract value from a specific third party (including brands, public figures, other creators, or trademark holders).
• We reserve the right, at our sole discretion, to reclaim, rename, suspend, or reassign usernames that violate these Terms, including usernames associated with squatting, resale, impersonation, trademark conflicts, hate speech, or prolonged inactivity. Where reasonable, we will attempt to notify you first; in cases involving abuse, harm, or legal risk, we may act without prior notice.

You agree not to use the Service to:

• Upload illegal, harmful, or offensive content
• Upload, publish, or distribute NSFW, pornographic, explicit sexual, or R18+ content
• Impersonate others or misrepresent your affiliation
• Distribute malware or engage in phishing
• Violate intellectual property rights of others
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service
• Use the Service for any illegal purpose

PHOOM is intended to be a portfolio and identity platform for creators. We reserve the right to remove NSFW, R18+, sexually explicit, or otherwise inappropriate content at our sole discretion, including when we believe it puts users, partners, or the platform at risk.

Content responsibility

You are solely responsible for all content you upload to PHOOM, including but not limited to images, videos, text, links, and model showcases. You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to upload and display the content
• The content does not infringe upon the intellectual property rights of any third party
• You have obtained proper permission to credit any artists, riggers, or collaborators mentioned
• The content complies with all applicable laws and these Terms

License grant

By uploading content to PHOOM, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your content solely for the purpose of operating, promoting, and improving the Service. This license continues until you delete the content or your account, except that content may persist in backups for a reasonable period.

Content removal

We reserve the right to remove any content that violates these Terms, infringes on intellectual property rights, is NSFW/R18+, or is otherwise objectionable, without prior notice.

If you believe that content on PHOOM infringes your copyright, please submit a DMCA takedown notice to our designated agent. For complete details on our DMCA policy and procedures, please visit our DMCA Policy page.

Counter-notification

If you believe your content was wrongly removed, you may submit a counter-notification. We will restore content within 10 to 14 business days unless the complainant files legal action. See our DMCA Policy for details.

Repeat infringers

We maintain a policy to terminate accounts of users who are repeat copyright infringers. Accounts receiving multiple valid DMCA takedown notices may be suspended or permanently terminated.

• Paid plans are billed monthly or annually in advance.
• Subscriptions automatically renew unless cancelled.
• You may cancel at any time; access continues until the end of the billing period.
• Refunds may be offered at our discretion; requests are evaluated individually.
• Prices may change with 30 days notice.

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Repeated attempts to upload prohibited content, including NSFW or R18+ material, may result in content removal, account suspension, or permanent termination.

You may delete your account at any time through the dashboard settings.

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, PHOOM shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
